Terms of Service

Acceptance

These Terms govern your use of Nanogram ("we", "us"), a social platform for short, AI-assisted browser games delivered through our mobile apps and website. By creating an account or otherwise using Nanogram you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

Eligibility

You must be at least 13 years old to use Nanogram. You confirm your date of birth at sign-up; accounts that do not meet the minimum age are refused. If you are between 13 and the age of majority in your country, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. We may close any account we reasonably believe belongs to a user under 13.

Your Account

You are responsible for everything that happens under your account, including any content you publish and the security of your password. Don't share your credentials, don't impersonate other people, and don't create accounts to evade a suspension. Notify us at hello@nanogram.app if you suspect your account has been compromised.

What You Can Post

Nanogram is a casual, all-ages-friendly platform distributed inside mobile app stores. Every game you publish is reviewed (see Automated Review below) against the rules in this section. Games that fail review are rejected and not displayed. Repeated or egregious violations may result in account suspension or termination.

Don't publish games that contain:

  • Sexual or pornographic content.
  • Graphic violence, gore, or torture imagery.
  • Hate speech, harassment, slurs, or content targeting protected groups.
  • Real-money payments, donation prompts, affiliate links, or any "monetize this game" integration — including Stripe, PayPal, Square, crypto checkout, ad networks, or referral trackers. (Purely in-game virtual currency is fine as long as it can't be bought with real money.)
  • Calls to LLM provider APIs (OpenAI, Anthropic, Google Generative Language, Groq, OpenRouter, Mistral, Hugging Face routers, etc.), even using your own key.
  • Backend-as-a-service connections (Firebase Realtime DB / Firestore, Supabase, PocketBase, etc.), IP-lookup or fingerprinting services, telemetry endpoints, or webhook capture.
  • Third-party image, audio, video, or iframe sources outside the small allowlist below (Imgur, raw GitHub, Wikimedia, Pixabay, Catbox, YouTube embeds, Roblox thumbnails, etc.). Inline your assets or upload them via Nanogram.
  • Use of (or requests for) device hardware and OS-level browser APIs: geolocation, camera/microphone (getUserMedia), Bluetooth, USB, Serial, HID, NFC, Contacts, push notification prompts, the File System Access API, or Service Workers.
  • Crypto mining, sandbox-escape attempts, attempts to exfiltrate data, or anything that tries to subvert the WebView the game runs in.

Network allowlist — the only external hosts a game may load from:

  • Relative URLs, data: and blob: URIs, and any https://*.nanogram.app/... URL.
  • JavaScript-library CDNs: cdnjs.cloudflare.com, cdn.babylonjs.com. (jsdelivr, unpkg, esm.sh, skypack are not allowed.)
  • Tailwind runtime: cdn.tailwindcss.com.
  • Fonts: fonts.googleapis.com, fonts.gstatic.com, fonts.cdnfonts.com, db.onlinewebfonts.com.

You also agree not to use Nanogram to harass other users, spam, scrape, reverse-engineer or interfere with the service, attempt to defeat rate-limiting or anti-abuse measures, or do anything illegal in the place you're using it from.

Automated Review & Discretion

Every published game is reviewed by an automated system (currently Google's Gemini) for safety, policy compliance, and an ESRB-style age rating. We may also review games manually. We may reject, hide, age-gate, modify the rating of, or remove any game at our discretion — including for reasons not explicitly listed above — and we are not required to publish or keep available anything you submit. Automated reviews can be wrong; if you think a rejection is incorrect, contact us.

Your Content

"Your Content" means everything you submit to Nanogram — including games, comments, usernames, avatars, and other materials. You are responsible for Your Content. Different rights apply depending on how a game is created, as described in the next two sections. For Your Content that is not a game (comments, avatars, usernames, etc.), you grant Nanogram the same broad license described under Uploaded Games below.

Uploaded Games — License to Nanogram

An Uploaded Game is a game you create outside of Nanogram's built-in game generator and submit to the platform (for example, code you write yourself or generate with another tool and then upload). You retain ownership of your Uploaded Games.

By submitting an Uploaded Game, you grant Nanogram a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to host, store, cache, copy, reproduce, modify, adapt, translate, create derivative works from, publicly display, publicly perform, distribute, and otherwise use the game, in any media now known or later developed, in connection with operating, promoting, and improving Nanogram and our other products. This includes the right to share the game with other users, feature it in feeds, recommendations, and marketing, and use it to train and improve the platform's recommendation, moderation, rating, and content-generation systems. Because the license is non-exclusive, you remain free to use, license, or publish your game elsewhere.

Generator Games — Ownership Transfer

A Generator Game is any game created in whole or in substantial part using Nanogram's built-in AI game generator, in-app editor, or other Nanogram-provided generation tooling — including any game produced by submitting a prompt, image, or remix request to our systems. Generator Games are built on top of Nanogram's prompts, models, templates, infrastructure, and review pipeline; we treat them as platform-owned content.

To the maximum extent permitted by law, you hereby irrevocably assign and transfer to Nanogram all right, title, and interest — including all copyright and other intellectual-property rights — in and to each Generator Game and any derivative works of it, throughout the universe, in perpetuity. You waive, to the extent permitted, any moral rights or similar rights you may have in Generator Games, and you agree to sign any documents and take any further actions Nanogram reasonably requests to confirm or record this assignment.

In the event any portion of the above assignment is held unenforceable, you instead grant Nanogram an exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to do anything Nanogram could have done as outright owner, including bringing infringement actions in its own name. You agree not to assert any claim of ownership or moral rights against Nanogram, its users, or its sublicensees in respect of a Generator Game.

For clarity, Nanogram grants you a personal, non-exclusive license to play your own Generator Games inside Nanogram on the same basis as other users.

Other Users' Rights & Deletion

You grant other Nanogram users a license to view, play, like, share within the app, and otherwise interact with your published games as the product's features allow. You can delete Your Content at any time; deleted content stops being publicly displayed but may persist briefly in backups and may continue to live on in cached, archived, or shared form outside our control. Deletion does not undo the ownership transfer of a Generator Game.

Copyright — You Are Responsible

You must own or have permission to use everything you publish to Nanogram, including code, art, sound, music, names, and likenesses. It is your responsibility to make sure your game does not infringe anyone's copyright, trademark, right of publicity, or other rights — whether the content was written by you, pasted in from elsewhere, or generated with the help of an AI tool. AI assistance does not change who is liable for the output. If you're not sure, don't publish it.

DMCA & Copyright Complaints

If you believe content on Nanogram infringes your copyright, send a written notice to hello@nanogram.app with:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you say is infringed.
  • A link or specific description of the allegedly infringing material on Nanogram (game title, profile URL, or anything that lets us locate it).
  • Your name, address, phone number, and email.
  • A statement, under penalty of perjury, that you have a good-faith belief the use is not authorized and that the information in your notice is accurate.

We will review valid notices, remove infringing content, and may notify the user who posted it. We will terminate the accounts of repeat infringers. If you believe content of yours was taken down in error, you can send a counter-notice to the same address.

Termination

You can delete your account at any time from within the app or via /delete-account. We may suspend or terminate your account, remove your content, or restrict your access to Nanogram at any time if we believe you have violated these Terms, applicable law, or our community standards — or if continuing to host your account creates legal or platform-policy risk for us. The license you granted in Your Content & License to Nanogram survives termination.

Service Provided "As Is"

Nanogram is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or that the service will be uninterrupted or error-free. Games on Nanogram are user-generated; we do not endorse them and cannot guarantee they will work on every device.

Limitation of Liability

To the maximum extent permitted by law, Nanogram and its operators are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption, arising out of or related to your use of (or inability to use) Nanogram. Our total liability to you for any claim arising from these Terms or the service is capped at USD 100 or the amount you have paid us in the last 12 months, whichever is greater.

Indemnity

You agree to defend, indemnify, and hold harmless Nanogram and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the service, or your violation of these Terms or any law or third-party right.

Changes

We may update these Terms as the product evolves. Material changes will be communicated in-app or by email; the "Last updated" date at the top of this page always reflects the most recent revision. Continuing to use Nanogram after a change means you accept the updated Terms.
